1. Agreement to Terms
These Terms & Conditions (“Terms”) govern your use of cend·ia·go. By creating an account, you agree to these Terms. If you do not agree, do not use our services.
cend·ia·go is operated by [Company Legal Name] (“we,” “us,” “our,” “cend·ia·go”).
2. What cend·ia·go Is
cend·ia·go is a marketplace platform that connects:
Senders: people who need parcels delivered internationally
Travelers: people flying internationally with spare luggage capacity
WE ARE NOT A COURIER OR SHIPPING COMPANY. We do not take possession of parcels. We do not employ travelers. We provide a platform for connections.
3. Eligibility
To use cend·ia·go, you must:
Be at least 18 years old
Have the legal capacity to enter into contracts
Not be prohibited from using our services under applicable law
Pass identity verification
4. Account Registration
You must provide accurate, complete information
You are responsible for keeping your password secure
You are responsible for all activity under your account
You must notify us immediately if your account is compromised
One person, one account — no sharing accounts
5. Identity Verification
All travelers must verify their identity using government-issued ID before listing trips. We use third-party verification services. By using cend·ia·go, you consent to this verification.
We may suspend accounts that fail verification or provide false information.
6. For Senders
6.1 Your Responsibilities
Accurately describe your parcel
Ensure your item is legal to send and import
Declare the true value
Not send prohibited items (see Section 7)
Coordinate handoff with the traveler
Confirm or dispute delivery within 48 hours
6.2 Customs Check
Our AI customs check is a tool, not a guarantee. You are ultimately responsible for compliance with customs laws. We are not liable if your parcel is seized.
6.3 Payment and Escrow
You pay when you accept a match
Funds are held in escrow by Stripe
Funds release to the traveler when you confirm delivery, or automatically after 48 hours if you take no action
Platform fee (12%) is non-refundable even if you cancel or dispute
6.4 Cancellation
You can cancel before the traveler accepts the match — full refund
After the traveler accepts, cancellation fees apply (see fee schedule)
If the traveler’s flight is canceled by the airline, full refund
7. Prohibited Items
You may NOT send:
Illegal items (drugs, weapons, counterfeit goods)
Items banned by airlines (lighters, large batteries, flammable liquids)
Items that violate import/export laws
Perishable food that requires refrigeration
Live animals or plants
Currency or monetary instruments above legal limits
Items requiring special permits without proper documentation
Sending prohibited items violates these Terms and may result in account suspension, forfeiture of escrow, and legal action.
8. For Travelers
8.1 Your Responsibilities
Upload accurate flight booking information
Only list trips you are actually taking
Inspect parcels before accepting them
Declare parcels according to destination customs laws
Carry parcels as your personal luggage
Take handoff photo in the app
Deliver to the recipient as agreed
8.2 Liability Model (CRITICAL)
BY ACCEPTING A MATCH, YOU AGREE:
You bear FULL responsibility for what you carry
You are responsible for customs declarations and duties
You assume all risks: seizure, fines, legal consequences
cend·ia·go is NOT liable for customs issues, airline issues, or legal problems
This is the same model as Airbnb uses for hosts
8.3 Right to Refuse
You can refuse any match request for any reason
You can cancel an accepted match if the flight is canceled (no penalty)
You can cancel for other reasons (cancellation fee may apply)
8.4 Payment
You set your own rate per kilogram
Payment is held in escrow until delivery is confirmed
We deduct payment processing fees (~2.9% + $0.30)
Payouts take 1-2 business days after delivery confirmation
9. Escrow and Payment Terms
9.1 How Escrow Works
Sender pays when match is accepted
Stripe holds funds in escrow
Contact details unlock after payment
Traveler uploads handoff photo
Recipient has 48 hours to confirm or dispute
Auto-release if no action after 48 hours
9.2 Fees
Platform fee: 12% of delivery fee (paid by sender, non-refundable)
Payment processing: ~2.9% + $0.30 (varies by payment method)
Currency conversion: handled by Stripe, their rates apply
9.3 Refunds
Full refund if traveler cancels or flight is canceled
Full refund if traveler never accepts the match
Partial refund if sender cancels after traveler accepts (minus platform fee)
Refunds if dispute is resolved in sender’s favor
Processing time: 5-10 business days
10. Disputes
10.1 When to Dispute
Item never delivered
Item delivered damaged
Wrong item delivered
10.2 Dispute Process
Sender raises dispute within 48 hours of claimed delivery
Escrow is frozen immediately
Our team reviews: handoff photo, chat messages, flight records
Decision made within 48-72 hours
Escrow released to the party the evidence supports
Decisions are final
10.3 Evidence
The handoff photo is the primary evidence. Without a clear handoff photo, we will side with the sender.
11. Ratings and Reviews
Both parties can rate each other after delivery
Ratings are permanent and cannot be deleted
Reviews must be honest and not defamatory
We may remove reviews that violate these Terms
12. Prohibited Conduct
You may NOT:
Use the platform for illegal purposes
Circumvent the platform to avoid fees
Create fake accounts or manipulate ratings
Harass, threaten, or abuse other users
Share false or misleading information
Use scrapers, bots, or automated tools
Interfere with platform security or operation
13. Intellectual Property
cend·ia·go owns all platform content, code, design, trademarks
You grant us a license to use content you upload (photos, messages)
You may not copy, modify, or distribute our platform
14. Disclaimers and Limitation of Liability
14.1 Platform Provided “As Is”
We provide the platform AS IS. We do not guarantee:
Uninterrupted or error-free service
Accuracy of listings or user information
That parcels will arrive safely
That customs will approve your parcel
14.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
cend·ia·go is NOT liable for any indirect, incidental, consequential, or punitive damages
Our total liability to you is limited to the amount you paid in fees in the 12 months before the claim
We are NOT liable for: lost parcels, customs seizures, flight delays, traveler misconduct, sender misconduct
14.3 Indemnification
You agree to indemnify and hold cend·ia·go harmless from any claims arising from:
Your use of the platform
Your violation of these Terms
Your violation of laws or third-party rights
15. Insurance (Future)
We are exploring insurance options for high-value items. Currently, NO INSURANCE is provided. Senders and travelers bear all risk.
16. Termination
16.1 You Can Close Your Account
Close your account anytime via settings
Outstanding transactions must be completed first
16.2 We Can Suspend or Terminate Your Account
We may suspend or terminate your account if:
You violate these Terms
You engage in fraud or illegal activity
Your account poses a security risk
You fail identity verification
If we terminate your account, you forfeit any pending payouts or escrowed funds (at our discretion based on the violation).
17. Changes to These Terms
We may update these Terms. Significant changes will be announced via email or in-app notification. Continued use after changes means you accept the new Terms.
18. Governing Law and Disputes
These Terms are governed by the laws of [Jurisdiction]
Disputes will be resolved in the courts of [Jurisdiction]
You agree to binding arbitration (optional clause — consult lawyer)
19. Miscellaneous
Severability: if any provision is invalid, the rest remain in effect
